Child custody is now called “Parental Allocation” The terms “custody” and “visitation” are now replaced by the term “parental allocation” in an effort to focus on each parent’ rights and obligations with the child or children in a more positive manner. “Parental Allocation” refers to each parent’s possession periods with the minor child(ren) and also refers to decision making authority. Decision making may be joint and equal, sole, or some cases a combination of the two. These issues are often the most emotional and complex issues involved in any of the legal actions for divorce, legal separation, and/or paternity actions.

The guiding principle in “Parental Allocation” matters is the best interests of the children. Our child custody attorneys work closely with our clients to assure that the interests of their family and their children are well represented. Under Illinois Parental Allocation laws, children do not choose which parent will be their custodial parent. However, depending on the age and maturity of a child, their preferences are given appropriate weight by the Court in determining Parental Allocation orders and judgments.
